Japan's First Trademark Registration Under the Consent System

On April 7, 2025, the Japan Patent Office (JPO) granted the nation's first trademark registration under the newly introduced Consent System.

The Consent System allows for the registration of trademarks that are identical or similar to existing ones, provided that the owner of the prior trademark gives explicit consent and there is no likelihood of confusion among consumers. This marks a significant shift in Japan’s trademark regime, offering greater flexibility in brand selection—particularly beneficial for new business ventures and startup companies.

The relevant amendments to the Trademark Act, which introduced the Consent System, came into effect on April 1, 2024. The system applies to trademark applications filed on or after the date of enforcement.

With this first approval, the Consent System is expected to facilitate broader and more strategic brand development across various industries in Japan.
